17 MILLION DOLLARS For San Jose: The war of empire, colonies and hunters is on the treasure!
The war of empire
After 309 years, a new battle for the giant San Jose began. “When the Colombian authorities announced that they were starting to work on pulling off the ship from the seabed, this galley, full of gold, became the subject of an international dispute. A new battle between the former empire, the former colony and the treasure hunters will be very interesting.
On June 8, 1708, San Giuseppe Galia was sent to Cartagena with more than 600 people. However, he was intercepted and assaulted by a British ship, “Expedition”, equipped with as many as 70 guns. “San Jose” was hit, there was an explosion and a gallium and the treasures were slightly sunk. On the ship were gold and silver leverage, precious stones and other treasures believed to be worth $ 17 billion today.
After nearly 310 years, a new conflict began. In 2015, the anthropologists and historians of the Colombian Institute, with the support of the navy of this Latin American state, found the remains of the galleys. Next year, Colombian President Juan Manuel Santos said San Jose will be lifted from the seabed so that on June 12 this year, a society was formed in which representatives of the state and the private sector participate.
There are a whole range of reasons why this treasure can be considered as exclusive property of Colombia, said the Marine Law Expert, director of the Maritime Analytical Center of the Columbia National University Antonio Hose Renhifo. For almost twenty years he has been fighting on various foreign courts to get Bogota eligible for this gallium.
“Everything started from the moment when a gallium search.
An American underwater research company announced in 1980 that it was determined to find San Jose and was granted permission to conduct underwater research. The company finds the remains of a ship that survived the shipwreck, it is obliged to publish where this wreck is located.
Also, the company that finds the remains of a ship has the right to a certain part of the goods that were on board. The volume of goods that a firm can retain regulates the legislation of the country concerned, “explains Renhifo. The exact location of the sinking “San Jose” was found and published in 1994 by the company “Si search armada”.
After the Colombian authorities granted this company the status of “applicants for research”, the company’s leaders did not stop there. They asked local legal institutions to determine exactly what their share was. After a three-year dispute, in 2007, the Supreme Court of Colombia found that a cargo carrying a galleon had the status of a national archaeological treasure, and that the said company belongs to half of what it found in the depths of the sea.
Renhifo challenged this decision and proved that the company had falsified documents at once. In response to the request of the “Si search armada”, Renhifo raised the question of the credibility of documents submitted by this company in 1982, with the request that they be allowed the right to conduct underwater research. Hence the suspicions of the Colombian expert in the legitimacy of the decision of the Colombian court.
Everything has changed since President Santos stated that the gallium was found by Colombian scientists.
Representatives of the “Heart of the Army” stated that Bogota found a wreck thanks to the coordinates they published. Renhifo claims that this is not entirely true, since the data, or coordinates provided by the US company, are not entirely accurate.
On all of this, Spain may also join this dispute, which always considered galleys as military ships and, accordingly, its own property, although this gallium was actually from the colony of Spain the value of others.
During his visit to Colombia in 2016, Spain’s Minister of Justice Rafael Catallo Polo said that this was a “Spanish ship, because according to the provisions of international law, the vessel belongs to the state under whose flag it sank, and in addition, hundreds of Spanish people were killed on the ship .”
“We believe that the proclamation of the day’s memory of the cultural heritage and sinking of this ship is the best thing that can be done in this situation and leave the boat to lie where it sank,” the Spanish minister added. Interesting is what will be the reaction of Madrid when Colombia pulls out a galleon from the seabed.
Renhifo, however, advises not to forget Madrid when there is a division of property and treasures.
“We should not underestimate Spain, a country that has so far succeeded on various meridians to obtain court litigation involving mite gangs. Spain has a large and efficient diplomatic machinery,” explains Renhifo.
At the Pier is a new battle between the former empire, the former colony and the treasure hunters. Everything points out that it will be very interesting.
